All of the contractors are proceeding with the transition to make the transition a smooth one. There will be no gap in service. All of the station personnel are cooperating. We are dedicated to our jobs. Many of us have been through contractor changes before. Whether challenges to the awards are in the works or not, I don't know - IMO, sounds like there should be. Meanwhile, we and they must proceed as if no challenge will be successful.

Question: do any vendors just refuse to negotiate period and try to put punitive terms on the union employees? What happens if the vendors refuse to negotiate? Worried about this right now.
Sounds like we went from a decent vendor to one of the scummiest.
Does PATCO do a good job of negotiating in these circumstances, or should I just prepare to take it?

This was my incoming contractors reaction when I notified them we had a CBA. linkIf worse comes to worse you can try filing a complaint with the National Labor Relations Board if you think you can't get anywhere with the union. One thing I do know for sure is the incoming contractor must pay current wage rates and fringe benefits for the first year of the contract if you have a CBA. If not file a complaint with the NLRB, this is a violation of the Service Contract Act section 4C. I think the scummy contractor you are refering too is trying to skimp on Sunday pay. They have to pay it if it is in your CBA.

The vendor should have known that your site has a CBA when they submitted their proposal. That is part of the solicitation. The union should certainly take swift action if they are notified that the company is violating any terms of the CBA, particularly when it comes to wages. If they don't, then what use are they?? Why belong to a union and pay dues if they won't serve and protect their members??
The Contracting Officer would also probably like to know about a violation such as this. It could be viewed as breach of contract and grounds for declaration of default.

Yeah, sounds like some of the contractors are not interested in fairness or union contracts unless "fairness" means everything to their own advantage at our expense - I have not had to work for one of those idiots. All of the five contractors I've worked for over 26 years have been reasonable people understanding that the worker is worth his wages and that their business depends on competent, contented, employees. PATCO knew this was coming and they will be working on it. Talk to them before you snipe at them please.

Just spoke with Henry Santana - some encouragement: CBA takes precedence over the contractors' contracts with the FAA - our CBA is a contract with the contractor, not the FAA, and no "executive order" can supercede anything in the CBA. ALL of the CBAs have successor clauses that bind any new contractor - they just can't unilaterally change ANYTHING in your CBA. Lance Geren is gearing up for new negotiations - hold your meetings, write up your proposals and get them to PATCO promptly.
