Would this be considered an error? Do the layers above have to be SCT?

I would say it is ok also ... say you have:
2/8's = FEW012, varying to at least 3/8's (as your remark suggests)
then above that you have a trace (more than 0 but less than 1/8) of 8,500 and another trace of (more than 0 but less than 1/8) of 25,000.
With both traces not adding up to 1/8th, so even the top layer (25,000) is still a FEW layer ...
Of course during the period when FEW012 goes SCT, so the mid and high deck do the same ... however the only remark of "FEW012 V SCT" is correct as it is assumed (correctly) that 85,000 and 25,000 would also be varying scattered ...
