Dear Brothers and Sisters,
Washington thus far has refused to stop the automatic budget cuts called sequestration.
It is our understanding that the agency is looking at closing a large majority of the Federal Contract Tower facilities on or about April 1, 2013.
NATCA is working to protect your rights in a number of different ways, but many questions remain to which we are seeking answers.
One key point is that all three collective bargaining agreements covering our FCT members have a Protective Provisions Article, which requires RVA, Midwest and SERCO to sit down with us as soon as possible to negotiate the impact of facility closures. We intend to pursue this vigorously.
Since the FAA has already issued a list of possible facility closures, and some facility closures appear to be imminent, NATCA has submitted formal requests to begin negotiations with each respective company. Issues that will be addressed include your pay and benefits impacted by the closure and the possible layoff and recall of bargaining unit employees.
Should RVA, Midwest and SERCO proceed to layoff employees, all three FCT contracts contain provisions requiring layoff and recall to be effectuated by seniority. In addition, contracts require the companies to cash out unused annual leave, 401(K) funds, and other such retirement accounts. Finally, the employer should continue to provide employees with Employee Assistance Program counseling services to assist employees with personal problems associated with the facility closures.
